General Terms and Conditions of the BfR Academy
For deliveries, services and products of the Federal Institute for Risk Assessment from the website of the BfR Academy.
Scope
These terms and conditions apply to participation in events of the BfR Academy as well as on the BfR Academy website (https://www.bfr-akademie.de/) offered products. They describe the relationship between the customer and the Federal Institute for Risk Assessment (BfR), Max-Dohrn-Str. 8-10, 10589 Berlin, exclusively applicable conditions, unless these are expressly changed by written agreement between the parties.
Registration for events
The subject of the contract is the possibility of participating in the event of the BfR Academy for which registration is carried out.
People can register online at the BfR Academy website, by telephone or e-mail as a participant in a BfR Academy event. Registration is also required if the event is public and free of charge.
The announcement of events on the website of the BfR (https://www.bfr.bund.de) or the BfR Academy (https://www.bfr-akademie.de/index.php/english/) is not a binding Offer. Only when you register online with the "Buy" button is a binding offer according to § 145 BGB. The contract is concluded upon receipt of the confirmation of registration by email.
The BfR reserves the right to carry out an approval process, for example. at training events. In this case, registration is only possible after approval by the BfR.
There is no general right to participate in free events.
Service
The following applies to paid events: In addition to participating in the programme, the participation fee also includes the costs for event documents and coffee breaks, as well as for further meals, provided this was previously mentioned in the event programme. Details will be published in the event programme.
Upon request, each participant will receive a confirmation of participation from the BfR.
Payment
The participation fee is due with the binding registration and must be paid without deductions within 14 days of the invoice being sent. Please also note that participation in the event(s) is only possible if your payment has been received in the BfR account at least seven days before the start of the event. Otherwise the booking will be cancelled. In this case, the participation fee will be charged as a cancellation fee. The payment method can be selected on the website of the BfR Academy (https://www.bfr-akademie.de/apff2024/). The payment is carried out with the help of the epayment platform "ePayBL" of the federal government (and the federal states). The BfR reserves the right to exclude certain payment methods for individual events. Payment in cash or checks is generally not possible.
Cancellation / Withdrawal
Cancellation is possible free of charge in written notification up to seven days before the event. The BfR reimburses the previously paid amounts by transfer to a specified account. Bank transfers are deducted for international transfers. Alternatively, another participant can be named until the start of the event. The BfR Academy requests notification as soon as possible.
In the case of events for which different participation fees are charged, the difference can be waived if the circumstances entitling the participant to more favourable conditions are notified in writing up to seven days before the event. Subsequent reference to this does not entitle to a waiver of part of the fees charged. Different fees may be charged for different participation groups, different types of participation (online or on-site) or according to the selection of partial events.
Changes in the programme schedule / cancellation of events
The BfR reserves the right to make changes to the planned event schedule in order to achieve the goals of the event even under changed conditions, such as cancellations by speakers. The BfR will inform you about changes before beginning of the the event by publishing an updated event programme on the website of the BfR Academy or the BfR.
If an event is not possible due to force majeure, disruptions at the event location, refusal of speakers or because the minimum number of participants is not reached, the BfR Academy will inform the participants immediately. In this case, event fees already paid will be refunded by bank transfer. A claim for reimbursement of travel and accommodation costs as well as loss of work is excluded, unless these costs arise as a result of grossly negligent or willful conduct on the part of BfR, a representative or vicarious agent.
Copyright
The conference documents for the events of the BfR Academy are protected by copyright. The participants are only granted a simple, non-transferable right of use for personal use. In particular, participants and third parties are not permitted to change the content of the conference documents - including extracts - or to use modified versions, to make them publicly available, to post them online or in other networks for free or free of charge, to imitate, resell or to use for commercial purposes. Any copyright notices, marks or trademarks may not be removed.
Image, film and sound recordings
Image, film and sound recordings of the events require the prior written consent of the BfR in any case. Failure to do so may result in claims for damages.
Right to your own picture
By attending the events of the BfR Academy, participants agree that the BfR can use images and sound recordings that were made at the event and on which the participants are shown, in terms of time, location and type of use without restriction, in particular for publication on the website of the BfR and the BfR Academy and in reports on the event. The BfR will use the images themselves or through third parties, but only for its own public relations work. Commercial transfer to third parties is excluded. The consent is given free of charge. It can be revoked at any time with future effect. The revocation takes the form of a declaration in writing or text to the Federal Institute for Risk Assessment. The revocation has no retroactive effect. Existing publications and other uses are not affected by it.
Liability
The BfR is not liable for the loss or damage of items brought to the event locations, including the cloakrooms. Each participant has to pay attention to his objects.
Liability of the BfR for compensation instead of performance and for compensation for other direct or indirect damage - including accompanying or consequential damage - for whatever legal reason is excluded. This does not apply if
- the damage is based on intent or gross negligence on the part of BfR, one of its legal representatives or vicarious agents
- a culpable breach of duty by BfR or its legal representatives or vicarious agents has resulted in injury to life, limb or health.
Online dispute resolution
If an online order is placed, consumers have been free to use the EU Commission's online dispute resolution platform since 15.02.2016 for the purpose of out-of-court dispute resolution.
Final provisions
Deviations from these general terms and conditions require an express written agreement in individual cases.
The contractual relationship between the participant and the BfR is subject exclusively to German law, excluding the UN Sales Convention (CISG). Internationally binding provisions of the state in which you have your habitual residence remain unaffected.
If you are a registered trader, do not have a general place of jurisdiction in Germany or move your domicile abroad after the contract has been concluded or your place of residence is not known when the action is brought, the place of performance and place of jurisdiction is Berlin.
The regulation contained in the previous paragraph does not apply to you if you as a consumer reside outside of Germany in another member state of the European Union, the European Economic Area or in Switzerland.
If individual provisions of these general terms and conditions are not or become ineffective, the legal regulations of the Federal Republic of Germany apply in their place; the validity of the other provisions of the terms and conditions remains unaffected.
